Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and PBJ Earth LLC, a Nevada limited liability company ("PBJ Earth," "we," "our," or "us"), governing your access to and use of Survivor Atlas (the "Services"), including our website (survivoratlas.com), simulators, contests, articles, blog ("Spyglass"), podcasts, and any free or paid features.

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old and legally capable of entering into contracts under Nevada law.

You agree to use the Services in compliance with all applicable laws and regulations.

2. Accounts

To access paywalled or premium features, you must create an account with accurate, current, and complete information.

You are responsible for maintaining the security of your account and for all activities under your account.

You must notify us immediately if you suspect unauthorized use of your account.

3. Paid Content and Subscriptions

By subscribing or purchasing, you authorize us (or our third-party payment processors) to charge the listed fees, plus applicable taxes.

Subscriptions automatically renew unless you cancel before the renewal date.

Payments are generally non-refundable, except where required by Nevada law.

4. Acceptable Use

You agree not to:

• Circumvent or attempt to bypass our paywall or security measures;
• Copy, distribute, or exploit content without authorization;
• Use bots, scrapers, or automated tools to access the Services;
• Interfere with or disrupt the Services;
• Engage in unlawful, defamatory, harassing, or harmful conduct.

5. Intellectual Property

All content, including simulations, articles, graphics, design, and software, is owned by PBJ Earth LLC or its licensors and protected by U.S. and international copyright and trademark laws.

Your use is licensed, not sold. You may access Free Content for personal, non-commercial purposes only. Premium Content is accessible only under an active subscription/license.

6. Termination

We may suspend or terminate your access if you violate these Terms or for any reason in our sole discretion.

Upon termination, you lose the right to access the Services, including Premium Content.

7. Disclaimers

The Services are provided "as is" and "as available." We disclaim all warranties, express or implied, including fitness for a particular purpose.

We do not guarantee accuracy, completeness, or reliability of any content, including simulations, predictions, or contests. You use the Services at your own risk.

8. Limitation of Liability

To the maximum extent permitted by Nevada law, PBJ Earth LLC and its affiliates will not be liable for indirect, incidental, or consequential damages.

9. Payment Processing

Payments are processed by third-party providers. Your payment data is subject to their terms as well as ours.

We do not store your full credit card details.

10. Modifications

We may update these Terms at any time. The updated version will be posted with a revised "Last Updated" date. Continued use of the Services after updates constitutes acceptance.

11. Privacy

Your use of the Services is also governed by our Privacy Policy (set out below).

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles.

Binding Arbitration

Any dispute, claim, or controversy arising from or relating to these Terms or the Services shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

Arbitration shall take place in Clark County, Nevada, unless both parties agree otherwise.

Judgment on the arbitration award may be entered in any court with jurisdiction.

Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and PBJ Earth LLC individually.

To the maximum extent permitted by law:

• No class arbitrations or class actions are allowed.
• You may not bring claims as a plaintiff or class member in any purported class, consolidated, or representative proceeding.

Opt-Out

You may opt out of arbitration within 30 days of accepting these Terms by sending written notice to PBJ Earth LLC at the address below. If you opt out, disputes will be resolved in the state or federal courts of Clark County, Nevada, and you consent to jurisdiction there.

13. General Provisions

Severability: If a provision is invalid, the remainder still applies.

Waiver: Our failure to enforce a provision is not a waiver of our right to enforce it later.

Assignment: You may not assign your rights without our written consent; we may assign ours.

Entire Agreement: These Terms, together with our Privacy Policy, form the complete agreement between you and PBJ Earth LLC.
